Pat and Frank,

I'm going to try as best as possible to stick to technical
facts and public knowledge and not engage in conjecture. I know
you'd like my opinions, but I'll withhold them for now.

Frank: the open access issue with AOL etc, is a hot topic and
I'm not in a position to make a comment at this time.

Pat: I can't speak for what vendors may or may not do with
their products, or may or may not claim as their advantage.
What I do know is that to pass DOCSIS 1.1, you have to first
be certified at DOCSIS 1.0 then DOCSIS 1.1. Therefore it
follows if DOCSIS 1.2 is built on DOCSIS 1.1, you have to be
certified at DOCSIS 1.0. I am not sure if CableLabs will
allow any other certification paths than what the above
logic presents. I have observed that CableLabs does feel
that a certified modem shipped at 1.x, would work on version
1.x, 1.x-1, etc CMTS. It's the only way they can guarantee
that a purchased modem will be universally deployable in the U.S.
