There is too often a direct conflict between 'the rules and procedures' and 'common sense and common decency'. This is a source of our system's original intent that juries act in judgement of law (rules and procedures, among other things) as well as fact.

That was a beautiful post- kinda. Even the last line- though my first inclination was to take exception to it. My interpretation of that last line, i.e. "The jury system, if it works at all, works only by setting its sights
low... " is that the power is in the people, we are the bosses, and we've got friends in low places. Pleasing? VBG
