Gene,

I find this stuff frightening. I consider the internet a conversational forum similar to a conference call between co-workers. The only difference being that I get to hear the views of people that I would otherwise never get to meet or know. Anything that scares or prevents people from expressing those views, whether I agree with them or not is an enormous net negative for all of us as far as I'm concerned. Talk about playing hard-ball. I never even thought of serving subpoenas duces tecum on third parties prior to serving the defendant with a copy of the lawsuit. That's pretty heavy duty stuff. But if the Rules of Civil Procedure in the forum allow it, it's ok legally, even though it's rude.

Sorry, I don't understand what right of privacy you think you have just because you use a nom de internet. If you are a party to a lawsuit, you don't have much in the way of privacy. Get used to it. I don't like it either, but I practice defensive strategies, like not saying things that are going to get me in trouble.<g> You may be free to say whatever you want, but you had better be ready to deal with the consequences.
