Lawsuits don't win any company friends. And they don't attract investors. Quality companies quash criticism by delivering on their promises. Companies which spend their time suing short-sellers and negative commentators usually don't do particularly well.

I would immediately short any company which thought the best way to defende it's repuation was by suing detractors. (HITT is a great current example of this...)

Take an example: Microsoft has been criticized more than any company in history, and Bill G has been accused of every evil under the sun including certain criminal activities. Can you recall Microsoft suing any of the people who said nasty things about them? Of course not. They just go out, do a good job, and deliver superb financial results which leave their detractors in the dust.

If you want to see the shorts shut up for good, you should encourage Darby to deliver a few quarters of sustainable earnings. THAT will probably cause all of us to go away for good...
