I think without penetration, it's just attempted whatever. The definitions are consistent with the Uniform Criminal Code, which we studied in law school, but I don't think is actually in force anywhere. It's something for legislatures to look at when enacting statutes. I know a few guys who used to be in JAG back in the old days, I even know a guy who used to be a JAG judge, I will ask them next time I run into them. Your memory of the event seems too clear to be confabulation.
