The case began in October 1996, when Kenneth Duane Porter brought his computer to the customer service department of the Dell Factory Outlet Store in Austin to repair a broken microphone jack, according to the court opinion.

An icon on Porter's computer caught a technician's eye. Even though it had nothing to do with the procedure for repairing the broken microphone, the technician looked at some files on the computer's viewer program and saw that one depicted a pre-teen girl engaged in sexual conduct, a prosecutor said.

Porter was found guilty of child pornography and sentenced to eight years of imprisonment, according to the court opinion.

"Porter said he never knew that anything he downloaded constituted child pornography," said William Harrison, Porter's former attorney. "He said he did view pornography on the Internet, but the stuff he viewed was legal -- of women."
