MP3 format wins appeals court ruling

In a major defeat for the recording industry, the 9th U.S. Circuit Court of Appeals in San Francisco ruled that Diamond Multimedia Systems Inc.'s, San Jose, Rio MP300 did not qualify as a digital audio recording device. Because of this ruling, the Rio is not subject to the restrictions of the 1992 Audio Home Recording Act. The suit was filed by the Recording Industry Association of America (RIAA), which had targeted the Rio and Internet MP3 music files calling it a major source of music piracy. The move further establishes MP3 and opens up the possibility for numerous other MP3 players to make it market in the near future. Creative Labs, for one, will roll out its Nomad MP3 player later this month. There are also plans to build MP3 players from at least another half dozen companies.
