Thanks, V. I saw your previous datek.com post, but I still disagree. So far, the datek.com deed has been done, and while there may be a datek.com rectification in the works, Russell's datek.com post leads me to believe that we will have no such datek.com luck.

But here is something for you to consider when it comes to intent.

If you order 1000 widgets from XYZ and his machine breaks down and he can't get the widgets to you and as a result you can't get 100 gadgets to ABC company..who in turn can't meet a deadline......can XYZ necessarily get out of the contract on the face of these facts with no repercussions just because he didn't intend to break the contract?

It is not so simple as you make it out to be
