Hi Daine,

There is absolutely a disconnect of dates and details.

1 ) According to Ventura Court documents, Franklin's injunctive relief complaint was filed on May 13, 1999.
According to the Franklin's SEC filing quoted below;

ITEM 1. LEGAL PROCEEDINGS
On April 5, 1999, the Company's subsidiary FNet Corp. ("FNet") filed a lawsuit to rescind an employment contract and to seek damages from a former terminated employee.

2 ) If that employee is James Magruder, he is referenced as both terminated ( above in the SEC filing )and resigned (Ventura Court Documents).

3 ) Of further interest is, how all you hear is that, this lawsuit is a non-event. Well, "not" according to the papers filed by Franklin. It is by no means insignificant or a non event.

4 ) Was it coincidence that the CEO decided to respond to "Bashers" the very next day, with the threat of lawsuits when details of the legal proceedings started to drift out in public ????

Daine, I will check later with the Court, as I have Register of Actions for the case, which details the chronological events and actions. It would seem from the reading of the register, that,

1 ) There was an order to remove the case to District Court filed by James Magruder ( Case # CV99-05647-AHM (MANX) ) on June 2, 1999.
2 ) An order to show cause re: James Magruder was vacated on June 4, 1999.
3 ) Final notation is that a scheduled "case management conference" for 9/23/99 was removed from the calender and the final note states: REMOVAL TO FEDERAL COURTS filed.

As for the Workforce Commission in Texas, I have no idea how Texas is involved. As a guess, I might say that James Magruder sought status in Texas in his employment contract. However, that is only a wild guess. Perhaps, copies of those documents would shed some light.

Did you attend the shareholders meeting ? If so, was the lawsuit discussed ?
