There are NO SEC rule that says you have to be a US citizen to participate in IPO deals. Just got the following from my broker:

"I did some research for you and unfortunately there is no rule that stipulates who is eligible to participate in ipo's. It is up to the underwriter as to who they want to offer shares to. I contacted the SEC and they said that they receive numerous complaints about this particular subject but at the current time there is no governing rule. Here is a link to the SEC web page where you will find some helpful information :http://www.sec.gov/consumer/search.htm ....scroll down on the left and there will be a topic about ipo's. I'm sorry I couldn't bring you better news and if you need any further assistance, please feel free to call me at anytime."

So, basically it is down to the underwriter CMGI chose to use for the IPO's, i.e. CMGI's responsibility.

I strongly recommend that all foreign investors unhappy with not being able to participate in this extra incentive to invest in CMGI to write to the SEC so that we might be able to lobby to have this changed.
