Of course we can only take analogy so far. In reality we are only playing games with this for fun. The law will decide, not analogies.

However- I'd like to explain one point of my analogy because it was intented to put in perspective a subtle but important point. The "land" in my analogy is *not* the cable plant, but rather the public right of way given to the MSO.
This "prime location" for the cable store is not something easily dupilcated by another store, something the public does gave to the MSO that they do have a right to take away. The question is whether the granting of that right of way gives the public the right to tell the MSO how to run its business.
