I am no CPA but as long as you are using a taxable account then I believe your thinking is correct. Anytime you sell at a loss it cannot be interpreted any other way.

The trick of course would have been able to properly identify the bottom.

Jim, I believe if you sell at a loss, you must wait 30(?) days to repurchase. If you don't wait, you cannot write off the loss. I think it's call the wash rule..?
