My understanding is that it is clearly illegal to give out investment advice without a license. The question is what exactly constitutes giving investment advice? I think the wording is important. If as steve host said, Mr. Pink actually issued a recommendation, then he could have a problem. Even his followers agree he is publicly issuing recommendations. But that is for SEC professionals to decide. Generally they will look into such things if they get enough complaints.

After all who wants to deny realty?

I don't think we need to do more to convince those Pinkies that IDTC is not the one to short. We have given all the facts and it's their money to bet. Actually the more they short the merrier. When IDTC starts to move, all the shorts are going to contribute to the explosive upward movement. In addition, I don't think the drops for IDTC in the last a few days have anything to do with Pinky (Though, he would love to have you believe so). It's the sector (check QWST, PGEX, etc.)! It's the market in general!
