[To dismiss Linux as a flash in the pan is really close minded.] It is. And claims that MSFT has no viable competition given the presence of Linux is equally absurd. Speaking of absurdity, we have Jackson's comments today. Does he think Wal-Mart's economies of scale should be illegal because no-one wants to compete with them? He's clearly going to stand on his head to declare MSFT a monopoly, but this type of thing on the record is very encouraging for the appeal. WSJ: Economist Says Microsoft's Bundling Of Browser Improved Windows' Quality interactive.wsj.com "The economist drew a comparison to competing grocery stores, saying the presence of one store doesn't stop another store from opening. But U.S. District Judge Thomas Penfield Jackson told Dr. Schmalensee that he had trouble with that analogy and asked whether a corner grocery store could compete with a "megamart" in the same town. "What happens when your potential competitor is always trying to play catch up?" the judge asked. Under questioning from Microsoft lawyer Michael Lacovara, Dr. Schmalensee said a megamart's advantage in pricing and inventory was simply competitive, not predatory. "This is the whole Wal-Mart phenomenon," Judge Jackson said. "What you're talking about is a benevolent despot."
