What the founding fathers wanted, and why, is less important than what we want, and why. In theory, I agree with you. I mean, like, who cares what a bunch of Dead White Guys thought? The problem is that when Americans disagree about what they want, then a Court usually gets called in to rule on whatever it is they disagree about, and the Court always rules on the basis of what those Dead White Guys said, or what they intended to say, in documents written more than 200 years ago...
