we could have tort reform - which means loser pays - which means all these frivolous suits go away The problem with loser pays, is the "little guys" won't be able to afford the risk of suing the "big guys". I think a better reform would be that punitive damages may not go to the lawyers nor the plaintiffs. (Where they should go would be a hot topic, however.) Lawyers would then have no incentive to go for large punitive awards for the drunk guy who climbs over a fence to fall into someone's pool. They would have incentive to go for the egregious acts that do have merit.
