I don't think the Supreme Court can rule an amendment unconstitutional, penni. Perhaps the lawyers among us can advise us on that one.

The Supreme Court has ruled against state flag-burning laws as well as the 1990 federal Flag Protection Act (I forgot about that one), on the grounds that they violated the 1st Amendment. The whole point of amending the 1st Amendment -- which is what the proposed flag-burning amendment would do -- is to tie the Supreme Court's hands.

Edit: At the same time, the amendment could be shot down along the way, if enough states refuse to ratify it. How likely is that?
