I actually had no idea whether cross-burning was illegal or not; I merely responded to Michael's question: why is it legal to burn a flag and not legal to burn a cross?

I'm glad someone has the initiative and time to actually look up the facts of the issue.

Actually, I think that you have covered it pretty well in this post. It is in fact the case that harassment is not generally viewed as protected, but that it must be narrowly construed...

By the way, although I had indeed heard of the case mentioned, a cursory search on various sites has shown me that the law remains unsettled on cross- burning, so it is still "illegal but subject to litigation" in some instances...
