I do not think the government or states are strong enough to make it that you cannot talk, just that you canot be holding the phone and driving at the same time. In England, they still do not limit the use of a phone while driving, although you may be more prone to get a ticket for something else if the guy sees a phone.

In my Mercedes, the hands free kit is totally voice activated and you need not even take your eyes off the road to dial, talk, hangup, etc. I cannot see why they would limit that in any way. Just the same as talking to someone in my car while driving, which I suppose if they wanted to limit, then the ACLU would certainly get involved.
