Pat: You might want to hit the thick book on the merger that was probably sent out to owners of JDS because usually these details are spelled out there.

Since I don't have JDS, I am not sure what the fine print says, but I have seen merger options in the past where they do not explicitly state that U.S. residents have to opt for acquiring company's share that will trade on US exchange. In such cases, if U.S. resident opts for equivalent shares that will trade on TSE, the tax implications are worded generally to the affect that you should talk to your tax advisor for tax consequences etc. etc.. FWIW.

Pat: Are you resident in Canada? Take a look at that 368 page document I mentioned this morning in a prior message...

From page 2... "Only JDS Shareholders resident in Canada are entitled to receive Exchangeable Shares to allow such shareholders to obtain a deferral of taxable capital gains in certain circumstances."

Join the Frustrated US holders of JDS Club. I got pummelled with a Short Term Capital Gain that knocked my tax bracket to the moon. Its almost like Uncle Sam's equivalent of a margin call.
