Great find, Cat!!! Haven't read it through, but the points you brought up look more like legal boilerplate to keep the company out of legal trouble later (almost all startups warn in such a manner). I would not worry about that as much as this document probably reveals how much Darby gave away with the debentured notes. Will review and give my take later.
