Refraining from abuse of process is not rolling over and playing dead. If the plaintiff has overreached, the defendant should use that fact to make himself a winner in the lawsuit. The defendant should not, instead, engage in the same kind of overreaching to score gains in other fora. It really is quite analogous to Anthony's lame claim to Robin Hood status, in which he purports to cleanse the markets of overreaching companies by overreaching, himself, against their hapless shareholders.
