Just a guess, but with the recent decision in Canada, the action of several "liberal" municipalities, press concern with the "digital divide" and income distribution, and an election year comming up with many pols looking for some populist flag to wave... open access in one form or another is becoming increasingly likely. The expansion if infrastructure will only be thwarted if the "rents" charged to non affiliated IPS are regulated too low. If Open Access gathers steam the FCC should provide guidance on any attempts to regulate prices. Also I suspect ATHM is already reworking their business plans to deal with open access. They have a powerful broadband competitive position (witness AOLs recent scramble at anything related to BB). Now if they would just put some Excite back into Excite I believe they will be able to compete under all but truely socialist market conditions.
