Trial in a Senate dominated by another party seemed to work out OK for Bubba and we know he was guilty as hell. Your concerns are overblown. JLA

This is the most stimulating post I've seen in a long time. Excellent. Even the process of impeachment of Johnson had it's problems politically. The outcome may have been correct but it was a politicized process.

I had a much smaller proposition during the recent Senate trial, where at least the Chief Justice should be allowed to determine whether the charges rise to that of impeechable offense. I might think that such a ruling would temper the politics of it. I might even prefer the determination to be made in the House, i.e., have the Chief Justice sit in the impeechment hearing and made the determination early in the process.

With some thought the only objection to your proposition might be that the Justices are appointed by the President [with Senate confirmation] and there is some risk there, in particular, with a required unanimous vote. But with Senate confirmation perhaps this is small.
