What we need is government leadership.

The reason everyone stays away from ATHM is because the FCC will not step up to the microphone and read the riot act to the "Open Access" religion.

Therefore, nobody knows what the rules are. Therefore, all the local neighborhood political figures start passing crazy laws. So you got Biker Bob in Middletown USA setting national guidelines.

Everybody also knows that it is entirely possible for politicians to pass a law saying T has to be able to send a 65" steel ball through a 1" steel pipe. It doesn't matter if it can't be done. You can't blame Biker Bob - somebody told him it could be done and Bob has no technical background.

It is tragic that the FCC does not recognize its responsibility and do something definitive. I thought it was the duty of government to set clear, definitive, laws so we could plan and run our businesses. When you leave everyone twisting in the wind like this you have national chaos.

Just think of all the wasted energy and money going on every day because nobody knows for sure what the law is.

The good news for us is that when the law is laid down it will be in our favor. The bad news is the FCC is dragging its feet as long as it possibly can and doesn't seem to care about the mess it is creating. If the FCC wants the court to settle things, we will have to wait until November at the earliest. How do you pressure the FCC??

Mary Meeker pounded the table recently, yet the stock has gone down. Not sure analysts are going to help much here.

ATHM had a nice business selling broadband access through cable modems. Too bad management decided to screw up a good thing by wildly overpaying for a second-rate portal. Now we have a bloated company that will NEVER be able to justify a market cap at this level, because there are so many damn shares outstanding.

That is why ATHM is now one of the weakest of the big internet stocks.
