If GM has had the forethought to assemble a whole list of uses that information can be put to-- safety-related, driver-ed related BS-- and to put in its operating manual nicely worded, open requests that anytime the airbag is deployed, wouldn't the driver please be a good citizen and let the company know so it can randomly check the monitoring devices and add the information to their safety-data base for the good of future drivers, then it seems as though (if they made a remotely plausible case for innocent uses) they could get away with it. It wouldn't be "without your knowing it" any more. It would be more like an invisible odometer. Keeps a record, is all. It could also be used by the driver in a liability suit, the company would point out. The manual would be sure to highlight that great advantage.
