I listened to the Lucent WaveStar OpticAir “media conference call” at noon today (not sure if a replay is available). At the time, i didn't realize this was so controversial so i didn't take any notes. Anyway it wasn't very technical at all, but they did address a few of the issued raised on this thread. This is some of what i remember hearing:

It has been tested is most of the major cities in the US. Smog, rain stuff like that are compensated for and they average over 99% at 3km. They figure they can add a few more 9's in the next couple of months so QOS should be in line with other Lucent products.

A caller asked about pigeons. They said a pigeon flying through the beam would not result in any data loss. Seagulls were not mentioned.

One of the questions on this thread was about sway in the buildings. That was not addressed, but they did say that the tested it on a boat (didn't say what size boat) 3 miles (i think) at sea with 4 foot waves and it worked fine. (They did not mention 4.5 ft waves)
It has some sort of a tracking thing.

The beam expand the further the travel. It is about two feet in diameter at 5km.

The Lucent people all seemed pretty excited about the system and are confident that it will be in production by March 2000.

As you all know, i don't have a clue about any of this stuff, but looking at this detailed “WaveStar OpticAir Network Map” it is clear that they have it all figured out:
