Marc,

Good point..I was looking for re-entry into ATHM at this level, but saw this this morning..

" Merrill Lynch analyst Henry Blodget said he did not believe isolated local decisions would have a major impact on Excite@Home, but that each additional decision against AT&T widens the crack in the regulatory door.

"We continue to believe that 30 percent to 50 percent of (AtHome's) stock value is attributable to its exclusive partnerships with cable companies," he wrote in a note to investors Wednesday. "While isolated local decisions are no big deal...we believe investors should keep close tabs on the overall picture."

In AT&T's favor, Blodget pointed out a California Senate bill that would have mandated open access statewide failed to gain support and died last week. "

Any opinions on how widespread this negative euphoria is ATHM more likely to revisit the 40 range or the 80 range over the next few months?

thanks,

Brian
