Don't underestimate the fickle mindedness of a jury. It is not certain that the jury will be considering Microsoft's position with index funds and most of the jury members may not even have investments in the stock market. The average jury is very easily swayed and impressed with big brother. The fact that the government has a case against Microsoft may influence some people to think that the government irregardless of merit. It will be interesting to see how the Bristol case ends up. The Bristol case sounds like the typical flea, cockroach and parasite case that Microsoft has been dealing with. The deliberation should not last too long and I would expect a verdict very soon

T2K: Juries worry me. They seem to automatically think that the guy with the money can afford it right or wrong. Then there is the Connecticut vs. State of Wash. mentality. Rationally one would have expected the judge to dismiss this frivolous grab at MSFT's wallet but here we are going to jury deliberation. I do take a little hope from the recent rulings and jury verdicts (absent FL) vs,. the tobacco cos. but these things are really quite unpredictable. It appears that if they lose this could unleash a new industry for trial lawyers -suing MSFT. In any event CPI report is setting the scene for a nice open. JFD
