They were focused on a hard drive, but included flash memory..from Betty's link to the patent.
"Audio programming is stored digitally on a non-volatile medium, such as a hard drive, or in a flash EPROM, or other solid state non-volatile memory. The device includes a hard drive, a modem for connection to a data base via an on-line service, a keyboard, a display, and an audio system"

Bob,

I took a quick look at the patent abstract that Betty posted earlier and it included this description:

"Audio programming is stored digitally on a non-volatile medium, such as a hard drive, or in a flash EPROM, or other solid state non-volatile memory. The device includes a hard drive, a modem for connection to a data base via an on-line service, a keyboard, a display, and an audio system."

That would seem to include flash memory. But without going into the actual patent, it would be premature to speculate on how broad the patent's coverage really is.
