Good answer! My point about the FCC 'stepping in' is based upon exactly this premise. The FCC under its mandate from Congress has got to establish a framework to enable a nation policy on cable Internet access. If they don't every jurisdiction will impose their own flavor and it will become nearly impossible for carriers, ISPs, and the such to comply.

This is different from the one-way CATV downloads of the past where the local towns determined cable TV rates and availability. We are now looking at 2-way commerce highways.

The FCC has maintained their hands off policy until these recent court rulings forced their hand. I expect within the next 6 - 12 months for the FCC to approach the courts for policy clarification.
