The FCC has expressed its policy; two franchising authorities to date have opted to take matters into their own hands. Its time for the courts to make it clear where Federal and state rights sit on this issue. Unfortunately, IMHO, the Oregon District Court got it wrong -- but I think J. Panner wanted to send a message to Washington that under the present environment the laissez-faire approach to broadband cable will no longer be sufficient to ensure needed investment in cable. JMO.
