Generally speaking, Copyrights are more important for Software than patents.

Further, something like VxWorks would want to strive to embrace STANDARDS (for example RPCs, TCP/IP, Berkely Sockets, Java), so its value would be in its open-ness and compliance to standards, rather than its propietary-ness and diveregence from standards (which would be needed to get a patent).

Hence, I see no problem with a lack of patents, since any Software IP would still be protected by copyrights.
