This is the May 6th release I was unable to "paste" yesterday: Business Wire - May 06, 1999 11:53 PLYMOUTH MEETING, Pa.--(BUSINESS WIRE)--May 6, 1999--Interactive Gaming Communications Corp. (IGC) (OTC BB:SBET) announced Thursday that on May 4, 1999 it had obtained a temporary injunction along with a search and seizure order of computers and software issued by the Canadian Superior Court and signed by the Honorable Francois Belanger, JES, against InterCapital Global Fund Ltd., T/A The Online Casino, InterCapital Canada Ltd., Alex Kennedy, Sandy Masselli, and Steven F. Savage, for the unauthorized use and possession of IGC's "LiveAction Gaming Platform(tm)," source code, and other copyright infringements. On May 4, 1999 The Montreal, Quebec Canadian Superior Court officers entered the offices of InterCapital Global Fund in Canada freezing the computers and software and putting a halt to the unauthorized use of Intersphere's software used in the operation of The Online Casino and Sportsbook. Unauthorized use and possession of copyrighted material carries both civil and criminal penalties, and IGC intends to seek the prosecution of all violators to the maximum extent possible under the law, and to seek the maximum amount of compensatory damages allowed by the courts. The defendants had been operating The Online Casino & Sportsbook (www.theonlinecasino.com), a wholly owned subsidiary of Total Entertainment Inc. (OTC BB:TTLN) on IGC's "Live Action Gaming Platform(tm)" under a software license from its subsidiary Intersphere Communications Ltd. since August of 1998. Recently it had been discovered by IGC that the defendants had improperly obtained portions of the company's proprietary and copyrighted source code and was representing itself as a casino software developer, a publicized fact that the defendants verbally denied. However the complaint alleges that the defendant's Total Entertainment website (www.totalentertainmentinc.com) which has a (c) 1998, advertises that they, "provide software that allows gaming license holders the ability to create an electronic entertainment and gaming facility, for use on the Internet." The web site further advertises that "Total Entertainment has also developed an Internet-based gaming package, which includes a 'back-end' gaming software package that transfers the 'front-end' information (i.e. card or dice numbers) between the user and the remote server." The site further states that "Currently these applications are being used by THEONLINECASINO." The IGC complaint states that the systems, applications and the functionality they describe and in fact are using are that of Intersphere Communications Ltd. IGC originally sent written notice to InterCapital that it was in violation of its licensing agreement and that the company was to discontinue the use of the software at once which InterCapital acknowledged, but InterCapital ignored IGC's request, and IGC was forced to move into the Canadian courts to seek relief. A former employee has been identified by the company as having taken part in the transfer of the source code and proprietary documents to the Total Entertainment's subsidiary and the defendants while in the employ of Intersphere. Both the local and Federal authorities have been notified and the evidence turned over to them for immediate action. The action taken by IGC against the defendants to terminate the agreement and prohibit further use of the software will have no effect on the revenues to the extent that the onlinecasino had paid the first year license fees in advance.
