The sweeping generalization that software is protected by copyrights, not patents is absolutely false. Ask any CEO of a software company. I don't know about the specifics of a particular type of networking software. I do know that copyrights are totally useless. Our patent counsel (for an internet company) is a patent litigator and he says that software patents are the ONLY means you have for defending this sort of IP. He should know, he makes a great living doing it and his plaintiffs collect a lot of licensing fees as a result of his efforts in courtrooms around the country.
