the FCC will step in make a national law

The FCC does not make laws.
Congress makes laws.
The FCC carries out laws.

The FCC can't do a damn thing. It has to wait until the courts clarify the law. If the FCC does not like what the court decides, it has to go to congress and get a new law passed.

Also, the FCC can't give both sides what they want.

1) We do not have a scientific method for having multiple ISPs yet. Some research is being done but it is a good ways away (if it can be done).

2) If you allow multiple ISPs, who decides what the rates are going to be? Nobody will agree. Does the government step in? If so, it is the end of everything because congress will be running the show - a sure death to the whole project.

There is much, much, much more than meets the eye here.
