There was a recent court case in the drug industry that opened a lot of eyes. A bogus suit was brought up. The company won the verdict in court. But instead of walking away they went on the attack. The pharm company sued those that tried to shake them down and won.

Brian, I wonder if this would be candidate for such action. If MSFT goes after Bristol, it might actually help them by detering future lawsuits. The only problem is that they need to see an even weaker than Bristol's "litigation lottery" type of lawsuit before proceeding. I would bet they have thought about what you said.
I still think Caldera's lawyers and the company itself would be very shaken by such news. Caldera's actions center around a time when MSFT was not close a operating system monopoly as it is today.

I think that lawsuit is being pushed by a Judge that feels jealous of Judge's Jackson's headline grabbing comments. He wants part of the action, IMHO. That is why he rejected many of MSFT's motions. He wants the media around his courtroom. I am not blaming him since it is a very human trait to want to be the center of attention. Now is his chance to have his face all over the news. I bet the judge be the most disappointed if MSFT and Caldera settle.
I think Caldera case is also being settled by jury but am not sure.

It is a shame those companies which can't compete in the free market
tried to push down their competitor in the court.
