As a lawyer, you can't just go through someone else's private
papers without a court order, and then only to the extent that the information in the
papers is relevant or may reasonably lead to relevant information.


You must not be following the same discovery rules as we are. Once a suit is filed, without any court order I can subpoena from third parties any non-privileged records that I consider relevant or that I think MAY lead to relevant matter. And I can issue requests for production for virtually anything I want, including diaries and check registers.
