My broker who is part of the underwriting, said if I got any of the shares and sold before 30 days, I could not be part of any other IPO's they have for 6 months. I imagine that is the disciplinary action?

not at all true. Penalty bid applies only to retail (the small minority of shares allocated), and even then, only at syndicate's bid (offering price).

Stock sold by retail accounts ABOVE the offering price (I guarantee that MP3.com WILL open and stay well above the offering price), hits a "free" bid, not syndicate's penalty bid.
