Yes it could, and because of this, the microcode steps in the execution would be different. For example, AMD might have used a microcode algorithm which gets 2 bits of IDIV results every loop iteration while Intel got 1 bit of result every loop iteration.

I suspect that Saturn grossly overstated the court's findings on AMD's microcode.
