Very interesting speculation re possible use of pantech chips without the "Digital by Qualcomm." Will depend on what the contracts say. If you are correct, MOT will say it doesn't have to under its contract. Q will say its contract with pantech required pantech to require MOT to use the slogan. That could lead to pantech license being terminated if its contract with MOT didn't have the requirement. Question could then center on whether MOT "knew" what the pantech contract provides. If pantech contract with MOT did include the requirement and MOT still didn't put the slogan on, then Qualcomm should, under its contract, have the right to enforce its patents in its suit against MOT. (Usually the patent holder has right to enforce even though through a licensee contract.) If MOT failed to put the slogan on as required by its contract with pantech, that contract could be terminated. That leaves the question of whether there is also a remedy to terminate the license to MOT directly, which theoretically for the point of argument has not been directly breached under my hypothetical.

What would really be the clincher is if MOT has put pantech chips in the StarTac. Game would be over in its suit against the Q.
