I find it hard to blame
the dead guy for being dead

I don't blame him for being dead.

But I do blame him if his irresponsibility killed two innocent people. I'm withholding judgment for now because not all the facts are in. But there is certainly an initial rebuttable presumption that he was at the very least negligent, if not reckless.
