Who writes about the outages at Etrade, or maybe less frequently AMTD? Or that some MMs are frequently fined for not honouring their own bids, but simply arbitrate the extra profits against the comparable small fines. ...

Since the NY Times article concerns itself with a current investigation it is not "old news". It is current news concerning a slow investigative and legal process of events that took place years ago.

It is relevent and demonstrates that regulators, prosecuters et al. have the patience to build a case and if successful in the courts, to punish individuals who may have thought they got away with it until brought before a judge and jury.

The legal transgressions have nothing to do with Datek's current business model. If the prosecution ever takes place and succeeds the company may suffer financially because of its heritage.

Let's put it a different way. Olsten (OLS) is paying a terrible price for its present ownership of a healthcare company that ripped off Medicare prior to any ownership or involvement by Olsten which has done nothing wrong. Can't be helped. Olsten acquired the wrong company. Not much different from Datek evolving out of the wrong company.
