I can easily picture a time say 2-3 years out when AOL can no longer deny that broadband will replace dial-up and when ATHM is no longer supply limited and could use a little extra demand.

Excellent point. But, as you suggest, AOL would lose much of the advantage it seems to believe that it holds today. Whether an agreement happened by then with ATHM or with the MSO partners, ATHM would be in the driver's seat.

I think AOL knows that and that's one reason they've turned in an oh-so-typical beltway manner to lawyers and lobbyists who are trying to slow down the roll-out of broadband services.
