Q v. MOT; seems like you need to get hold of the exhibits to the complaint, i.e., the copy of the Patent License Agreement. Perhaps the complaint references a confidentiality clause as the basis for not attaching it to the court clerk's--i.e., public file.

The investor/investee relationship of MOT to Telular makes the complaint all that more intriguing. You know MOT is heard loud and clear in Telular's board room.

Qualcomm counter suit against MOT:

Qualcomm alleges that both companies cross-licensed any patents (in addition to their own) that either has the right to license which are technically or commercially necessary to make and sell certain CDMA and Dual-Mode wireless products.

First, the only patent of which I am aware that MOT is claiming infringement is a design patent for a folding phone, and I have to say I am not certain how the folding phone design patent falls under this category. I guess it is time to look up Telular's patents.

It sounds like the lawsuit is referring to the first two patents ('894,'637). They deal with a way to hook up a WLL phone alongside a POTS phone.


SUMMARY OF THE INVENTION

An object of the invention is to allow a facility, normally wired for a single telephone line from the wireline telephone company, to become a two-line facility, with the second line coupled to a wireless communication system and remain fully compatible with all FCC Part 68 devices, including standard telephones, (both, single and double line), facsimile devices, alarm systems and modems.

Another object of the invention is to allow a consumer without any tools or knowledge of a telephone system to use the invention by easily allowing him to use his standard house telephone wiring and add a cellular communication capability as an additional line to his current system without improperly coupling an active device to a landline telephone outlet.
