CCF and Unicom--Good news/bad news and a proposed solution:

Dictating terms of termination to erstwhile investors amid their demands for compensation would make great reading for the IPO Prospectus. I wonder how the CCF contracts' forum selection clauses read, i.e., as an investor, does the "irregular contract" (The government has argued that the CCF joint ventures never had legal status and the formula was not in line with international practice) require you to bring suit in Chinese mainland courts? Almost as bad as requiring you to bring any actions in the courts of Texas!!! <gg>

This is real and has to be sorted out. The easiest way out (time to market--in a different context from engineer's), and face saving for everyone involved, is to give the supposedly prejudiced investors a piece of the action, i.e., shares in the global offering. This way, there is no issue about irregular CCF contracts and the investors have the same risk that all other investors have. If they are so convinced that monetary compensation on a pv basis of their initial investment is inadequate, let them jump in with the rest of the $3 billion in funds and individuals.

A portion of $3 billion sounds like a nice piece of change to roll out CDMA in China. [It had earlier been reported, I believe, that a portion of the offering proceeds would be used to expand Unicom's GSM system.]
