I agree--the Niners would beat the Bengals under any circumstances. Phillips was the best available guy out there, so I probably would have signed him too. Here's the latest from the Bengals:


        Bengals guard Matt O'Dwyer faces a $3.82 million civil suit from three policemen who allege he injured their eyes during a bar brawl two weeks ago in Long Beach, N.Y., that took 31 officers to control.

        The suit was filed in New York Supreme Court, Nassau County, Monday, when O'Dwyer also was brought up on four criminal charges that included two felony counts.

        O'Dwyer's criminal proceedings were moved to Aug. 16, but he told the Bengals he wasn't sure if the case was close to being resolved.

        O'Dwyer said he would return to Cincinnati tonight, and the Bengals expect him Friday for the start of train ing camp.

        Although O'Dwyer faces a fine and/or suspension as well as counseling for violent behavior, the NFL usually waits until the legal system acts.

        Lawyers for O'Dwyer couldn't be reached Monday, but the lawyer for the policemen urged the Bengals to place O'Dwyer in anger counseling.

        “One of the reasons the Jets got rid of him was for all the penalties he committed after the whistle. Certainly he has behavioral problems,” said Long Island attorney Lawrence Elovich. “The offensive behavior and outrageous conduct committed and their wanton disregard for others rises above ordinary assault.”

        Also arrested were Jets offensive linemen Jumbo Elliott and Jason Fabini. One male and one female firefighter are suing Elliott for $2.5 million, alleging he punched them.

        Fabini, a University of Cincinnati product, isn't being sued because he didn't commit assaults, Elovich said.

        “Matt O'Dwyer kicked out the right rear window of the police car, causing glass to shatter with shards of glass cutting and embedding the face and eyes of police officers John O'Sullivan, Dean Burke, and Anthony Rivelli. O'Dwyer also kicked police officer Rivelli in the hip and struck another police officer.”

        Elovich said all the officers had injuries to their corneas. Rivelli, a Nassau County officer, also has back and hip injuries. Burke, a Long Beach officer, is back to work. O'Sullivan, also a Long Beach officer, is expected back to work.

        O'Dwyer, 26, signed a two-year, $2.7 million deal with the Bengals last month; he is expected to start at left guard.

        He has apparently told the Bengals there is more to the story than has been made public, but Bengals President Mike Brown wouldn't comment Monday.

        “He hasn't even been convicted of a crime,” Brown said. “It would be premature to discipline him for something when he hasn't had a day in court yet.”
