Tang, don't you think that it is significant that MSFT timed the "Instant Messenger" issue and decided to take it up with AOL so close to the reconvening of the DOJ. They are out to prove to the jury that everybody including AOL want to protect their turf. They tried to drive home the point with AOL-SUN-NETSCAPE alliance. And I am assuming that their intelligence sources have told their lawyers that the strategy failed. So they have decided to shift the focus of their case by bringing the issue of "Instant Messenger" out in the open.

MSFT is a smart company and they could the seen the business opportunity in "Instant Messenger" (if their was any) long ago. WHY NOW?
