The Manning rule allows Nasdaq MMs to match buyers and sellers whose limit orders are between the Bid and Ask. Thus, the prices are better than their expressed limit orders. In this case, there was a buyer at 38 1/2 which was matched against Tom's order, giving him a short sell at the high of the day.
