Marimba Files Patent Infringement Against Novadigm

MOUNTAIN VIEW, Calif.--(BUSINESS WIRE)--Aug. 2, 1999--Marimba(R), Inc. (Nasdaq: MRBA), a leading provider of Internet-based software management solutions, today announced that on July 30, 1999 it filed an action for patent infringement against Novadigm, Inc. (Nasdaq: NVDM).

On July 6, 1999, Marimba was issued United States Patent No. 5,919,247, entitled "Method for the Distribution of Code and Data Updates." In its complaint, Marimba alleges that "Novadigm has been for a time past and is currently infringing (the) Patent." Marimba's complaint seeks monetary damages, as well as an injunction to prevent Novadigm from making, using or selling infringing software products. Marimba's complaint also seeks to have its damages tripled for Novadigm's willful infringement.

Kim Polese, president and CEO of Marimba said, "Novadigm is attempting to enter Marimba's market space in any way possible, including using Marimba's own patented technology and ideas to compete with Marimba. Regrettably, Marimba was compelled to bring this lawsuit in order to protect itself and its shareholders from the misappropriation of its intellectual property."
